General Terms and Conditions of Use

The business directory Nautic Port offers you an interactive directory. The following conditions apply to the use of nauticport.com:

1. Description of the Service

As a registered user of nauticport.com, you can enter links to your internet sites and recommend these to other users (after having been verified and activated). This feature is not only available for businesses, but also for private users.

Because the checking of direct links to websites (deep links) takes a considerable amount of time, we have limited the number for each user to five.

On the home page you can see which recommendations are new, which have received the most clicks, and which have the best recommendations.

In addition, nauticport.com offers businesses the possibility – depending on availability – of publishing branded content, classic-style advertisements, and notices on the internet, which go beyond the normal banner-style ads. The details can be arranged separately by contract.

As a registered user, you receive the right to use all the functions of nauticport.com. With the conclusion of the user contract, no ancillary copyright, intellectual property rights, or other industrial property rights will be transferred to you as the user. This applies in particular to brands, names, photos, etc.

Despite the careful operation of our server, it can happen that planned or unexpected disruptions occur. In the case of planned maintenance work, we will promptly inform you about it. The right to claim to uninterupted availability of our service is not valid.

2. Changes to the Terms of Use

The terms of use for this service can be changed at any time by nauticport.com, with or without prior warning, as long as this is reasonable to you, taking into account the interests of nauticport.com. Should you happen not to agree with a change, you are obliged to end your usage of the service and to withdraw from the user contract.

3. Conclusion of the Contract and Registration

To use the entire range of services offered by nauticport.com, especially setting up links, you must be registered as a user.

A contract with us comes into effect after you have sent us a completed and correctly filled-out registration form (the offer) and we have activated your offer (acceptance).

The registration and appointment of your user account and a basic directory entry are free of charge. You are obliged to give your personal details truthfully when registering. If your details change after registration, you are obliged to immediately update your profile or inform us of the changed details.

User names may neither infringe on the rights of third parties, nor be in breach of public morals, nor be in any other way illegal. You are responsible for all activities which take place under this user name, and for the safeguarding of your password.

We reserve the right to reject your request for registration or your directory entries without stating reasons.

After we have accepted your registration, we will confirm this with you by sending you a confirmation-link via email.

4. Copyright, Trademark Rights

Our service contains links to content and other material that is protected by copyright, or by other trademark rights, either by us or by third parties who have granted us permission to use this content or material, within the framework of relevant legislation in Germany and other countries (this shall henceforth be referred to as "material").

nautic.port allows you to access and download a single copy of this material exclusively for private, non-commercial use. You may not sell, edit, display, publicize, distribute, or make multiple copies of the material, or use it for any other public or commercial purpose, without previous written permission from nauticport.com. For the use of certain software programs and other elements provided within the framework of the service, special rules may apply, which will made known where applicable.

nauticport.com is and remains the bearer of all rights regarding or relating to the service provided.

If the material posted on this service is protected by patents, (including utility or design patents), copyright law or trademark rights, you or the third party who is entitled to these rights will remain the bearers of the rights. In this case you are responsible for the protection and/or defense of these rights.

By posting material on the directory, you grant nautic.port the unlimited right to use this material, in particular to reproduce, propagate, display, publicize, make publicly accessible (especially on the internet), as well as to edit and alter the material. Furthermore, you grant nauticport.com the right to use the posted material to the same extent on the websites of third parties, in particular on those of partners of nauticport.com. The right to use this material expires when the corresponding material is deleted from the directory.

5. Content

You are responsible for all data, texts, information, links, and other content which you post. This means that you and not nauticport.com bear exclusive responsibility for all content which you publish, post, upload, send, distribute, or in any other way transmit. nauticport.com takes no responsibility for this content, including its accuracy, completeness, or usefulness, and is not liable for any losses or damages arising from the use of content posted on the directory.

The service provided is moderated by nauticport.com. nauticport.com is therefore under obligation to check content as it is posted. nauticport.com checks, controls and monitors this content. nauticport.com is entitled to delete or refuse to publish at any time any content which goes against a statutory duty or violates the terms of use, as well as at its own discretion, without stating reasons.

6. Rules of Conduct

You therewith agree that you are responsible for your own conduct and posted content during the use of this service, as well as for any consequences which may arise from your conduct. You undertake to only use the service for the sending and receiving of notices and material which are lawful, appropriate and relevant, in particular:

  • you may not defame, insult, harass, or threaten anyone, or in any way infringe on the rights of a third party (for instance personal rights);

  • you may not post content which is inappropriate, defamatory, obscene, pornographic, unsuitable for minors, or otherwise harmful to children or young people. Furthermore, you may not post content that violates laws and other statutory provisions, or which infringes on the rights of third parties;

  • you may not post content which infringes on patents, brands, utility or design patents, copyright, trade secrets, know-how, or any other rights of third parties;

  • you may not pretend to be another person or legal entity, or falsify or supress the identity of the author of a posted file; nor may you falsify or remove the legal signs or ownership references or marks identifying the origin or source of software or other parts of a posted file;

  • you may not prevent other users from using the service, or disturb or limit the useage of others;

  • you may not use the service for unlawful purposes;

  • you may not remove copyrights, trademarks, or other indicators or signs relating to the service;

  • you may not disturb or disrupt the service or servers or networks which are associated with the service. You must abide by the requirements, guidelines, and terms of the networks associated with the service;

  • the use of Robots and Spiders is not allowed, nor are applications which enable searching for and accessing sites, nor the use of other tools which allow you to access or index the service completely or in parts, or allow you to gather information about users without their consent;

  • you may not create user accounts with automatic processing or under false pretences;

  • you may not make available or assist instructions for undertaking unlawful activities, nor assist the physical harm or injuries of groups or individuals; and

  • you may not transmit or introduce viruses, worms, mistakes, trojan horses or other destructive elements.

7. Links

nauticport.com provides users with links to other websites and various other sources of information. Because nauticport.com has no control over these websites and sources, you are required to acknowledge and agree that nauticport.com is not responsible for the availibility of these websites or the sources provided by third parties, that nauticport.com takes no repsonsibility for the content of these websites and resources, and is therefore not liable.

8. Indemnity

If third parties should claim against nauticport.com in connection with their use of the service, they are obligated to indemnify nauticport.com from any liability, as well as to reimburse the costs arising from the violation (including all legal costs). In such a case, you will receive a written notification from us.

9. Duration and Termination

If you do withdraw from your user contract, you can decide whether the content you have posted should be deleted, or whether nauticport.com should continue to make it available according to the terms of use.

10. Blocking

nauticport.com can block a client if there is concrete evidence that the client has violated these terms and conditions or the rights of a third party (in particular copyright or trademark laws), or if nauticport.com has another legitimate interest in having a client blocked. As soon as a client is blocked, he or she may no longer use the website www.nauticport.com, and may not register again.

11. Advertisements

nauticport.com is a service which is financed in part by advertisements. Only nauticport.com is entitled to decide on or change the type and amount of advertisements. nauticport.com is not obligated to check these advertisements before their placement on the website.

12. Instructions about the right of withdrawl for users

You can revoke your contractual statement within one month in writing (e.g. letter, fax, email) without stating reasons. The one-month period begins at the earliest upon receiving these instructions. In the event of a valid revocation, any services or products received, and any profit derived therefrom, if any, such as interest, shall be returned. In the event that you are unable to return the services or products received in their entirety or at all, or where you can only return them in a deteriorated state, then you will be liable to pay compensation to us accordingly.

Your right of revocation will expire prematurely if we have completed the service with your explicit agreement before the end of the revocation deadline, or if you intiate this yourself (e.g. through downloading etc.).

13. Data Privacy Protection

It is known to the user and he or she agrees to the fact that the personal data required for the processing of the user contract will be saved on a data carrier. The user gives express permission for the collection, processing and use of his or her personal data. This includes all data which are required for the processing of the contract arranged between nauticport.com and the client, in particular their name, address, date of birth, contact details (telephone and fax numbers, e-mail address); but also the anonymous analysis of data sets which were requested, as well as the analysis of the name of the file, the date and the time of the query, the volume of data transmitted, the access status (file transmitted, file not found etc.), a description of the type of webbrowser used, and the IP-address of the user shortened to the last three digits. The records of the above-mentioned data will only be analyzed for statistical purposes, namely in order to get an overview of the frequency with which individual segments are accessed. This completely anonymous analysis helps us to adjust our internet service to your needs.

Furthermore, according to the German law § 29 BDSG, nauticport.com is entitled to collect, to save, or to alter the personal data given by the client. However, nauticport.com is not entitled to give this collected data in the form of a list or in any other compiled form in the sense of the German law § 28 Abs. 3 Nr. 3 BDSG to third parties for advertising purposes.

All saved personal data will be treated confidentially. The collection, processing and use of pesonal data is carried out under observance of the German Federal Data Protection Act (BDSG), as well as the Telecommunications Media Act (TMG). The user is entitled to the right to revoke his or her agreement at any time, which is also valid for the future. In the event of this happening, nauticport.com is obligated to immediately erase the personal data of the user. In the case of ongoing user contracts, the erasure of data will take place after the cessation of the contract.

14. Miscellaneous

All legal relations between nauticport.com and the client comply with German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
